• Article 1. The site
The site www.lyscosmetics.eu (hereinafter the "site") is an e-commerce site accessible via Internet at the address www.lyscosmetics.eu. The site is accessible from all subjects connected to the Internet system (hereinafter users).
The site is the property of the Lys (hereinafter "Lys").
LYS through the site www.lyscosmetics.eu is authorized to sell its products, including cosmetics and perfumery products (hereinafter the "products ") to users who visit the site.
Under these general conditions of sale (hereinafter "CGV"), the term "parts" will be conjointly indicated by the users and LYS and with the term "part " one of the two disjointly. The term "Purchaser" will indicate all users who have entered an order for the purchase of products. To the client will refer to and apply the same rights and obligations as those provided in the CGV for users.
Users who wish to buy on the site, aware of the civil and criminal liability in case of false declarations, declare that they have a legal age for the purposes of Italian law.
Each purchase order of products offered on the site implies the consultation and the express acceptance of the CGV, without however that such acceptance is conditioned to a signature by hand of the user. In accordance with articles 1321, 1322, 1326, 1335 of the Civil Code, to D. LGs. N. 21/2014, to D. LGs. N. 185/99, implementation of Directive 97/7/EC, and to the D.P.R. 513/97, the compilation and dispatch of the order form, referred to in the following art. 4 "Methods of insertion and confirmation of orders", constitutes to all the effects a law contract of sale between LYS and the Website User, from which arises reciprocal rights and obligations governed by the civil law.

LYS can update the CGV at any time.

• Article 2. Products
The products that LYS offers for sale are those listed on the site, and on the date on which users consult the site, within the limits of availability of the stock and subject to the conditions laid down in the paragraph 1, as well as the following restrictions. For transport reasons, products catalogued as aerosols are excluded from the sale; Products containing alcohol (perfumes) are allowed in the volume limit of 200ml for order. The photographs showing the products do not fall within this contractual scope.
Despite the commitment to ensure a faithful reproduction of the colours of the products represented in the photos published on the site LYS compared to the original ones, are not excluded hypotheses of differences, in particular due to technical limitations in the reproduction Computer Science of colors. Availability of products
The products are offered in the limit of the available stock. In case of unavailability of a product the user will be informed as soon as possible.
Users will be able to enter their email address in order to be informed as soon as the product becomes available again. If payment of a non-available product has been made by means of a LYS credit card, it will return the price of the product unavailable by recrediting the amount relative to the buyer's current account.
In the case that the unavailability of a product is communicated after the order has been confirmed, the buyer will have the option to cancel the order or requesting the reimbursement of the amount paid selling an e-mail.
LYS shall not be held liable in the event of a breakdown of stock or unavailability of the products. LYS reserves the right to change at any time and without notice what is proposed and published on the site.
Reserve property.
The required products will remain the property of LYS until the complete and total price collection. In the event of a failure, partial or incomplete payment, the Purchaser undertakes, at his own expense, to return, at first request, all products purchased and delivered by LYS.
Without prejudice to the reserve of property mentioned above, the risks associated with transport (in particular theft and damage) of the products ordered shall be borne by the purchaser.
• Article 3. Prices and methods of payment
Price
The prices of the products are given in Euro and are inclusive of VAT.
The price invoiced to the buyer is the price set in the order confirmation sent by e-mail from LYS.
The price set does not include delivery costs, which will be billed apart and specified to the user before the order is confirmed and at the time of confirmation and final validation.
LYS reserves the right to modify at any time the prices published on the site, in any case, the products, subject to availability, will be invoiced on the basis of the rates indicated at the time of registration of the order. The current rate will be the one indicated on the site, except for the case of typographical error.
Payments
All payments must be done immediately through Internet. Unless the server is unavailable, the user will be able to make the payment in the following ways:

Users can consult for free the various pages of the site, without any obligation of purchase.
Registering an Order
If a user wishes to enter and purchase an order, he will have to choose the various products of his interest clicling the "Buy" button.
Every new product added to your cart will be indicated by means of a specific window. Users can at any time:
-View the products you have chosen and change your order by clicking on the "Cart" button, located on the top right of each page,
-Resume the selection and purchase of the products by clicking on the button "continue purchases ",
-Finish the product selection and complete the order by clicking on the "Purchase " or "Purchase for a Gift" keys.

Confirmation of an order

• Article 5. Delivery
Delivery terms and Conditions
The orders will be organized by the logistic center and shipped by the shipping service.
The average time required to receive the products ordered is about 3/7 working days that date on which the order is received.
In any case, orders will still be delivered at most within thirty (30) days from the date of confirmation of the order by the user.
The products ordered by the buyer will be delivered to the address indicated by the buyer on the order form. The buyer is obligated to provide the correct residence and/or domicile address when proceeding to the order of the products.
Delivery issues
LYS shall not be liable for cases where the delay of delivery is caused by transport services and in cases of loss of the products ordered.
In case of delay of delivery, the buyer will be required to inform the customer service of LYS as soon as possible.
The buyer in such a case may at his discretion grant a further term to LYS.
In case of failure to comply with the terms of delivery or that which may be granted, the buyer is subject to the right to terminate this agreement within the meaning of article 61 D. Lgs. No. 21/2014.
It is also stated that the risks of transport are borne by the purchaser, as well as those relating to the loss or damage of the products since the latter acquires physical possession.
After receipt of the products ordered, the buyer must verify that the products correspond to those ordered. Any anomaly found (products missing or spoiled, parcel of shipment damaged, etc.) will be noted by the buyer and made present to LYS.
All disputes sent over 14 working days following the day of delivery will be refused and LYS will be freed from any liability.
• Article 6. Right of withdrawal
In full compliance with the law, the buyer has a period of 14 working days to return the products if they do not satisfy and keep the products until such time. This deadline runs from the day of delivery of the order.
In the event of an ascertained breach of the provisions of article 49, paragraph 1), point (h)) of Legislative Decree No. 21/2014, pursuant to Article 53 of the recalled D. LGs., the guaranteed withdrawal period to the buyer shall be extended to twelve months following the termination of the withdrawal Initial. LYS may provide the purchaser with the information referred to in article 49, within 12 months of the established infringement, and the right of withdrawal shall terminate fourteen days following the day on which the purchaser has received such information.
In case of purchase of several products, delivered at different times, the above term will run from the receipt of the last asset subject to the purchase order.
This notice of withdrawal can be sent by registered letter.
The right of withdrawal can only be exercised by the purchaser and not by third parties.
In the event that the buyer claim the non-recognition of the right of withdrawal by LYS, for failure to receive the notice of withdrawal, it will be the buyer's burden to prove that he has fulfilled you.
Exclusions of the right of withdrawal

Products that do not meet the consumer
If the purchaser exercises the right of withdrawal, the products must be returned in their original packaging and must be accompanied by the addressed located at the bottom of the invoice or transport document.
LYS will not accept parcels for which the transport costs have not been paid. All risks related to the return of the products will be borne by the buyer.
In the event that the above conditions are complied with, LYS will reimburse the purchaser within a maximum time period of 14 working days from the date of the order cancellation notice, the amount of acquisition corresponding.
The buyer will be responsible for the decrease in the value of the goods resulting from a manipulation different from that necessary to establish the nature, characteristics and operation of the products.
LYS will refund using the same means of payment used by the buyer for the initial transaction unless otherwise agreed.
LYS is not obliged to reimburse the additional costs if the buyer has expressly chosen a type of delivery other than the least expensive one offered at the time of purchase.
LYS, in the period of 14 working days, may withhold reimbursement until the buyer has received the goods or has shown that he has shipped the goods
NON-Conforming Products:
Products sent accidentally by LYS or which have defects or flaws.
All non-conforming products must be returned, by post, to LYS within 14 working days from the date of receipt, in their original packaging.
